way. fox 5 weather team has your forecast. we begin with new details about the 911 outage during the derecho storm in june. verizon is detailing its failures in a new in depth report. thanks for joining us tonight. i'm shawn yancey. >> i'm brian bolter. several lawmakers are asking for the fcc to step in to improve service. >> verizon conducted an internal. it came up with this 10-page report acknowledging failures, failures with backup batteries and generators that disrupted 911 calls that weekend after the storm june 29th. now verizon says it's conducting an audit of its power backup system, but three northern virginia congressmen say that is not enough. the powerful winds swept derecho did tremendous damage. verizon 911 service centers in fairfax county, prince william

county and manassas got no 911 emergency calls for several hours on june 30th. manassas park did not receive any much of the weekend. >> the largest problem was power failures of generators in two of our central offices, fairfax and arlington. >> reporter: tony lewis is verizon's vice president and says backup batters were completely drained but that the company is conduct an audit of all of its 911 critical facilities in the entire region to try to ensure such widespread outages don't happen again. virginia conman gerry connolly is not satisfied. >> i think it's a very self- justifying report by verizon and begs the question of what happened on the weekend of june 30th? and why didn't you have backup? >> reporter: why was't the system test? how come multiple fail pures.

jim moran and frank -- failures? jim moran and frank wolf sent a letter to the federal communications commission wanting telecommunications companies to provide at least eight hours of backup power at all cell sites. >> the whole point of 911 is in an emergency is works. we could have had people die. >> reporter: some of connolly's constituents also have thoughts about the summer's 911 outages. >> we were complaining about the electricity being out and that's all you saw on the news was that, but 911 is a little bit more of a big deal. >> that's definitely dangerous for 911 going out for even a short amount of time. that's dangerous thing. so i'm not sure if auditing costs a lot of money, but even if so, i think that's a good plan. >> reporter: now verizon shouldn't have problems paying for their internal audits. the telecommunications giant made $10 billion last year and took in $110 billion in

revenue. >> do the virginia congressmen have any other concerns outside of the nonworking backup batteries and generator failures? >> when i spoke with congressman connolly, he was pretty fired up about that entire verizon report. he said it was unacceptable and did not provide adequate explanation for what happened during the storm. he complained that there was poor communication between verizon and the local governments that whole weekend of the storm. he said the local officials were in contact at least once an hour. he thinks it was just outrageous verizon made no serious effort to be in touch. >> karen gray houston tonight. iowa playing post to both presidential campaigns today. the president used a stop in the hawkeye state to bring agricultural issues to the forefront. meantime the romney ryan ticket tried to keep their focus on the economy. fox's nicole collins has the latest. >> reporter: campaigning in drought stricken iowa president obama announced $170 million in

agriculture aid and accused mitt romney's running mate, wisconsin congressman, paul ryan, of blocking help for farmers. >> he is one of the leaders of congress standing in the way, so if you happen to see congressman ryan, tell him how important this farm bill is to iowa and our rural communities. >> reporter: the house budgets chairman ryan also campaigning in iowa has demanded cuts in farm bill spending. battling hecklers at the iowa state fair, he did not respond to the president and instead kept his focus on the economy touting romney as the man who knows how to create jobs. >> this is a man who has real life experiences who knows that if you have a small business, you did build that install business. >> reporter: romney appeared in florida where many of the state's seniors are closely watching ryan's budget and medicare plans. romney hit back against the obama campaign that today released this web video accusing the gop ticket of wanting to gut medicare.

put together the most specific comprehensive package to deal with the fiscal future of this country. republicans love that about paul ryan. democrats believe it's an incredibly juicy target in states like florida where the revamping of medicare in the ryan budget might be a huge issue and also in the swing state of pennsylvania, second highest in concentration of elderly voters and possibly in ohio. so there's the advantage of a specific budget, a bold set of ideas but also the potential peril of those political ideas not resonating in the very swing states mitt romney must carry to prevail. >> let me ask you about a previous article you did, an obama campaign advisor david axelrod is betting on tim pawlenty getting the vp nod. what impact do you think paul ryan will have on the president's reelection campaign? >> obama headquarters told me saturday look, we have been trying, meaning them, the campaign, for weeks to make this election not referendum on the president's economic record which is what republicans have been trying to, do but make it a big choice about the

direction for the country. they believe mitt romney adding paul ryan to the ticket, it's a big choice, a huge difference in the path this country can take based on the vote for president. that's what the obama always wanted. they believe that accusing romney and ryan of a plan that cuts taxes for the wealthy, changes medicare, possibly reducing benefits is right in their sweet spot politically in the short time remaining to debate big political issues. they found the ryan addition to the ticket an unexpected gift saturday. >> certainly we all agree sarah palin was a game changer for multiple reasons in 2008. do you think paul ryan is a game changer? >> look, every presidential candidate, when they choose their running mate, that changes the game for about a week. look, paul ryan cannot give mitt romney a vision. he can't elect him president. he can't even guarantee him his homestate of wisconsin. what mitt romney has to decide now is does he bring all of

paul brian's vision, his budget ideas, enthusiasm and energy and make it his? if he can, ryan is in that plus, but if he can't, if he distances himself from his own running mate, the democrats will pounce and make romney pay for a decision he made. >> major garrett, white house correspondent for national journal, thanks for coming in. >> thank you. new details on a fire in prince george's county earlier today. investigators say the woman found inside the burning apartment died. the woman's name has not been released. the fire was relatively small in a first floor apartment on landover road in cheverly. residents in three other apartments were forced out by damage. investigators are looking for the cause. fairfax county police investigating a fiery crash that killed a man and seriously hurt a police officer around 3 a.m. on franconia road in alexandria. the car crossed the center line and slammed head on into the marked police cruiser. the car caught fire and the man was killed. the service trapped in his

vehicle, eventually freed and taken to the hospital with serious nonlife threatening injuries, a seven year veteran of the department. >> we had a pretty gorgeous day, but you may need your umbrella tomorrow, some stormy weather heading our way. let's check in with gary mcgrady to find it out what we can expect. >> that would be a good idea if everybody kind of knew where that umbrella was, especially tomorrow afternoon and evening, some scattered showers and even some thunderstorms around as well. tonight 80 degrees in the city. it's cooled down in some places right around 70 degrees you see for frederick, gaithersburg at 73 degrees. something has changed, though, the last couple hours at least from the district to the south and that is that the moisture levels have been creeping up, the dew point going up now. we were in the upper 50s this afternoon. we're now into the upper 60s. that's going to make it feel more muggy and it really has begun to creep up areawide. hagerstown is still 62 degrees

for dew point. that's not time, but given more time they'll be close to 70 for everybody overnight tonight. clouds are coming in and there is the possibility that even tomorrow morning we may have a few scattered showers out. if you look at satellite and radar, there's definitely cloud moving in. you see rain back out to the west. that rain will fall apart before it gets here. we may have a couple showers reenergize tomorrow morning. also there's a chance for the thunderstorms, some of which may be severe, i think we'll have a few strong storms, maybe a couple severe storms, but really it all depends on sunshine for tomorrow. if we get a little more sunshine than i expect, storms will be a little stronger and we may fall into this slight risk area where it's actually realized by tomorrow afternoon. so definitely some showers and thunderstorms back in the forecast, question is how strong are they going to be able to be tomorrow afternoon and tomorrow evening? >> hopefully not too strong.

three people are dead including the gunman after a shooting near texas a&m university. police say the gunman was being served an eviction notice when he opened fire from inside a home near the campus. fox's casey steigel has the latest. >> reporter: an eviction notice leading a gunman to fire shots from inside his home wounding several people and

killing a constable serving him with the papers, this according to police in college station, texas, who came upon a chaotic scene. >> there was a constable down in the front yard. as additional officers began to respond to the location, they were able to engage a gunman. they were able to -- they ended up shooting the gunman. >> reporter: the man behind the assault rifle died after being taken into custody. his bullets flying through the neighborhood in college station just about 2 blocks from texas a&m's campus. the university sending out an alert to students. >> that a bullet whizzed right by my room. >> reporter: this is at least the third mass shooting in the last month, 12 dead in a colorado movie theater and six dead at a sikh temple in wisconsin. the presumptive gop nominee reacting to the news. >> clearly there's going to have to be consideration given to how it is these tragedies could be prevented.

i don't have the answer for you today, but it's something i'm going to give thought to and i'm sure a lot of other people in the country will do the same. >> reporter: police say the gunman information his mid-30s, but his name and previous criminal record, any, not released. the constable 41-year-old brian bachmann who died had been in law enfyears. the trial of a baltimore man accused of murdering a north carolina teenager will take place next year. prosecutors and lawyers for michael johnson agreed to the postponement today. the trial will begin in january. he's accused of murdering 16- year-old phylicia barnes, his former girl friend half sister in 2010. prosecutors say johnson killed barnes in her half sister's apartment and got rid of her body in the susquehanna river. today marks the one year anniversary of an american contractor's kidnapping in pakistan. rockville's warren weinstein was abducted at gunpoint on his way home from work. earlier today his family sent

out an e-mail asking for his release. weinstein is 71 years old. the e-mail said in part warren loves pakistan and dedicated his time and energy to work with the people. i don't understand why he was taken or if he's okay or being treated well. my husband is not in good health. the family is asking anyone who can help secure his release to contact them. a welcome home for a fairfax county teen-ager hurt in a freak accident. knick ballenger was hurt last month vacations in haw ma. fox 5's bob barnard has the -- hawaii. fox 5's bob barnard has the story. >> reporter: they're a spirited groups, nick's friends and classmates from his class of 2013. >> i couldn't believe it at first. i thought it was a rumor, but when i saw it, i wanted to show my support and be here for him today.

>> reporter: they're gathering outside medstar's national rehabilitation hospital in the district waiting for nick to arrive. >> we want himton we're all here for him. we all like are praying for him and thinking about him. >> reporter: this is what happened when his ambulance arrived after the short ride from dulles airport. he'd been flown in from hawaii where nick was paralyzed on a beach last month. this is a photo from a few years ago. >> nicholas, if he's not sleeping, he's moving. he's the consummate athlete and he was doing flips in the wave. >> reporter: and landed on his head dislocating two vertebrae in his neck. >> he was born there 17 years ago and we had planned to go to three different islands and we got there and our first full day there is when the accident occurred, our first day at the beach. spent his birthday in icu in

the hospital he was born in. >> he's very upbeat, more than i thought he would be. >> reporter: his buddy nick mcintyre visited nick ballenger in hawaii, came away encouraged. >> we were making some jokes and he said he saw his abs for the first time. obviously we were making an impact on him, which is good. >> yesterday at 5:00 he actually moved his knee, so that's really positive because we hadn't seen any movement chest down since the accident happened. >> reporter: his mother says nick, a pitcher for lake braddock's 2012 state championship baseball team, is trying to keep a positive attitude. >> he's always checking his phone. one of the first things he asked after his accident where's my phone because he needed to make sure all the text messages were there from his friends and stuff, just the support and the prayers, too really help. so that daily checking of the phone was really encouragement

drivers are feeling pain at pump because gas prices are on the rise again. the national average for regular unleaded close to 3.70 a gallon, here in our area gas in the district averaging 3.97 a gallon, in maryland 3.67, virginia 3.55. we have the explanation what's fueling the increase. >> reporter: we have a slowing economic recovery, high unemployment and now americans are dealing with another hardship, rising gas prices.

according to the latest lundberg survey the national average for a gallon of regular gasoline is $3.69, up eight cents from last week and up 30 cents from one month ago. analysts partially blame temporary production issues at some u.s. refineries for the spike, but the cost of gas could start to head back down. >> the end of summer is near and fortunately or unfortunately for some people that time will mean lower gasoline demand. the kid get back to school. we're starting to switch back from epa summer gasoline back to winter gasoline. i think prices will drop back to the mid-3.50 range. >> reporter: it's not just american families feeling pain at the pump. as those families spend more on gas and less on consumer goods, u.s. businesses also take a hit. >> any time that you have people spending money on gas, they're not going to their businesses and i think that in a time like today where typically people are going on

vacations, now they're not doing. that they're not going to restaurants. they're not going to retail. , so of course, that's going to have an impact on business. >> reporter: the gas price spike is coming at a bad time. second quarter gdp growth slowed to 1.5% while unemployment ticked up to 8.3% in july. vdot crews will begin removing dangerous trees from county land tomorrow in fairfax county. 59 trees were recommended to be taken down because they're dead, decaying or in danger of falling. the decision comes after a man died when a decaying tree fell on his car on georgetown pike last month. a 200-year-old church in culpeper reopened its sanctuary after a half million dollars worth of repairs. last year's earthquake damaged the church, stained glass windows some of the many items fixed and replaced at st. stevens episcopal church. next the maryland casino clash, what's holding up major progress on a bill to bring

the port of new york is trying to explain how a stranded jet skier climbed a fence and walked across two runways at jfk airport without being detected. daniel casillo easily breached the state of the art security system wearing a bright yellow life jacket. he was later arrested and charged with criminal trespass after making it to terminal 3 without being noticed. the incident also raises questions about reagan national airport. could the same thing happen here? fox 5's paul wagner takes a closer look. >> reporter: this is national airport as it looks through the long lens of our camera

shooting from haines point across the river. there is no fence and anyone who swam ashore or came on a boat could presumably walk upon the airport grounds. unless there is something near the runway our camera couldn't see, there doesn't appear to be a barrier to keep a determined person from running onto the run way. oddly there is a fence stretching from the north side along the riverbank but ends near one of those warning sides. part of it is protected by what appear to be surveillance cameras mounted on poles. a spokesperson for the airport authority says it's against policy to discuss security, but anyone standing near the point today would have been able to see a police car traveling the perimeter of the airport in the river and in the river d.c. police have jurisdiction patrolling the waters with the u.s. coastguard. up in new york the port authority was trying to learn how its motion sensors and other equipment in a $100 million system did not detect

the breach. passengers wondered the same thing. >> slipper they need to look at vulnerabilities like that -- certainly they need to look at vol americans like that from the waterside -- vulnerabilities like that from the waterside. >> it doesn't speak well for the people who are responsible and that requires investigation so it won't happen again. >> reporter: the port authority of new york says it has stepped up patrols at the airport while it reviews the breakdown and how it happened. the stranded jet skier said he called for help and when it didn't come, he swam the 3 miles towards the lights of the airport. a union official with the port authority police told the new york post that they had been concerned with the perimeter security for quite some time. they have sounded the alarm, but nothing has been done. in the fox 5 newsroom i'm paul wagner. some changes could be coming to the washington airport's authority board. now transportation secretary ray lahood could have his face, he'd replace some of the current members. lahood tells the washington post he has serious questions

about the how the board is operating. a recent audit found questionable spending and contracting. lahood recently appointed someone to oversee the board's operations. with the maryland senate already on board the house delegates now considering whether to expand gambling in the state. the debate is still underway. some delegates want to lower the amounts of taxes the casino in anne arundel county and a planned casino in baltimore would have to say saying that would offset a potential loss of business if a sixth casino is built in prince george's county. >> the well is only so deep. if you put four 7-elevens on a corner, they're going to day. >> if you ask 188 lawmakers, i don't think you're listening to the voice of the people. i'd like to see the voters decide. >> if the bill the house ways and means committee does pass it will head to the full floor for debate. a maryland congressman is saying no to a d.c. commuter tax the representative elijah cummings told the baltimore sun

the move could lead to a turf war in which everybody will be taxing everybody. darrell issa who chairs the house committee that oversees the district's affairs proposed the idea again saying it should be looked at after the election. we have an update on the health of congressman jesse jackson jr. the illinois democrat is being treated for bipolar disorder. the congressman was diagnosed with bipolar 2, a condition characterized by a less serious form of mania. the clinic says also he's responding well to treatment and regaining strength. jackson has been out of the public eye since he took a secretive leave of absence from congress about two months ago. evangelist billy graham remains in a north carolina hospital tonight where he's being treated for bronchitis. the 93-year-old was admitted to the hospital in asheville overnight in stable condition. he's responding well to treatment. helen brown, the woman behind cosmopolitan magazine is

dead. brown served more than 30 years as editor and chief. she was the force behind turning the magazine into a single girl's book of glamour. she was also behind the women's movement. she's famous for penning the 1962 bestseller sex and the single girl. brown died after being briefly hospitalized in new york. chef 90 years old. up next why the aclu is taking the happiest place on earth to court. >> some critics have harsh predictions for the redskins this season. rg3 gives us his take. talk about a bailout obama administration boosting its forecast on expected monthses from the auto bailout by more -- losses from the auto bailout more than $3 billion. the government is still on the hook for around 30% of gm's stock and would have to nearly triple for us to break even. meanwhile that pain at the pump is becoming a real pain, gas prices now up for the 15th

president clinton and a bi-partisan congress helped end welfare as we know it,

by requiring work for welfare. but on july 12th, president obama quietly announced a plan to gut welfare reform by dropping work requirements. under obama's plan, you wouldn't have to work, and wouldn't have to train for a job -- they just send you your welfare check. and welfare to work goes back to being plain, old welfare. mitt romney will restore the work requirement, because it works. pope benedict's butler will stand trial on charges he stole documents from the pontiff. the papers exposed allegations of corruption inside the vatican. the butler helped the pope get dressed, served his meals and attended mass with him. documents he's accused of leaking deal with corruption and power struggles in the church hierarchy. a fellow employee accused of helping gabriel has been ordered also to stand trial. the walt disney company sued on discrimination on behalf of a muslim woman because she was not allowed to wear a headscarf in public view while on the job in disneyland. >> she would have been better off, acceptable to disney, as a cartoon character rather than a flesh and blood employee. >> i don't understand why is it hard for me to work there and be accepted as a woman -- as a muslim woman or an american woman who just decided to wear her head scarf and have a

six time pro bowl receiver ted johnson out of jail, out of a job. the dolphins released johnson after being arrested for allegedly head butting his new wife over the weekend. he changed his name from ochocinco after his wife found a receipt for a box of condoms and they had an argument. >> he loomed over and head butted her in the head. he claims she leaned towards him and they butt heads. she had quite a laceration on her forehead.

play 80-yard drive resulting in a touchdown by pierre garcon. the bar was set pretty high. now the expectations have risen. is that okay with the new qb? >> the expectations and the hype and all the excitement, i think that's good. to see the fans come out and support their team, i think guys feed off those type of things. i don't think it will be a burden. i don't think the team feels like there's any pressure, but, of course, people will throw expectations out there, but last time i checked they still have us fourth in the nfc east and not that we care, but we're going to go out and try to make sure that we're not fourth. >> what a good attitude. griffin will see extended playing tomb saturday when the redskins play at the bears -- time saturday when the redskins play at the bears. we'll at 11:00 we'll have an update on the offensive line and a couple injuries.

>> got to say today was awfully nice, good respite. >> humidity was low. it was nice for a change. >> tonight you'll notice the humidity has come back up again just like that and it gets a little more humid for tonight and tomorrow. that means thunderstorms are coming our way. i think we'll have some showers and thunderstorms, too. a beautiful picture of the capitol tonight. high temperature today pretty hot, but again when the humidity is in check, it's almost doable, isn't it? temperature for a high for national was 90 degrees, a little bit cooler for dulles and bwi sitting at 88. so again the humidity has come back, so you'll begin to feel that a lot more out there for tomorrow. 80 degrees here in town, gaithersburg 73, manassas 73, culpeper down to 70, fredericksburg 74. temperatures won't fall too far tonight out in the suburbs simply because we do have more moisture coming in. that will tend to keep the temperatures up a little bit. so with the humidity on the way

up, we'll have mostly cloudy skies overnight tonight. it does look like we'll be in for a spotty shower tomorrow morning. that could also be a thundershower, so it wouldn't surprise me if tomorrow morning early we don't hear a little bit of that rumbling around, moving quickly through and then in terms of tomorrow afternoon, tomorrow evening another chance for some showers and some thunderstorms. there is a chance tomorrow afternoon that some of these thunderstorms could be on the strong side, maybe even severe. i do not think we'll have a big problem with that tomorrow afternoon and tomorrow evening simply because i just don't think we'll have a lot of sunshine tomorrow, more sunshine meaning a better chance for stronger or severe thunderstorms, less sunshine tomorrow, a slightly lower chance for anything going severe. so i think we'll have a little bit of sunshine, but i don't think we'll have enough to create a problem and give us a chance for the severe weather. tonight we're watching some showers back out to the west, a lot of this being gobbled up by the mountains as it comes

across, but i do believe this is some of what we'll see moving through tomorrow morning. anything that holds together and comes on across, it may actually get a little stronger as we head into tomorrow morning. we can already begin to see the clouds moving in, though. so we're mostly cloudy now and we will be more like cloudy overnight tonight as these clouds thicken up a little bit. low in town down to 73, winds out of the south, southeast 5 to 10 miles per hour and again we'll talk about a chance for a few sunrise showers early tomorrow morning and that's exactly what futurecast is saying. this is tomorrow morning at 7 a.m., a couple showers or thunderstorms up around 70 here and then farther back out to the west. so just keep that in mind. we could have some just in time for the morning commute. as we progress through the day tomorrow, futurecast is showing a little sunshine and with that some showers and thunderstorms popping up. this is 6:00. so not a lot of coverage. i think that's what we'll have tomorrow afternoon.

we wait till tomorrow evening because back out to the west as the frontal system gets closer to us, that will push up some more showers and thunderstorms and this is 11:00 tomorrow night. you can see the line here from central sections of pennsylvania right on down to the northwestern sections. by then that is the frontal system out to the west that's really going to help kick off the showers and thunderstorms again. we have some tomorrow morning, tomorrow evening and then some later tomorrow evening. so temperatures tonight only down to the 70s. we start off with the middle 70s tomorrow morning. mostly clouds at noon. i think if we see morning showers, we'll dry up in the afternoon. we'll have some sunshine and then out come a few thunderstorms for the evening hours. temperature of about 86 to 87 degrees for highs tomorrow, some places maybe a little warmer, some places maybe a little cooler. again it's all dependent on how much in the way of sunshine we're going to have. wednesday, thursday the frontal system comes in, kind of gets hung up. so that means at least we'll

she was tested before and after her winning match. both samples came back positive. now the gold goes to new zealand, the silver to russia, bronze to china. here's something for all you thrill seekers and weekend warriors. the obstacle course challenge, each year thousands of daredevils trek to northeastern pennsylvania to put their athletic skills to the test. fox 5's wisdom martin shows us. >> reporter: what are these people doing and why? virtually overnight obstacle course races have become a top destination for thrill seekers and weekend warrior as like. hundreds of events around the country -- warriors alike. hundreds of events around the country made runners go up, over and through to the finish line. this race in the pocono mountains is called warrior dash, more than 10,000 people scaling walls, leaping fire and crawling commando style through a mud pitted topped with barbed wire. it's grueling, mud spattering and legions of fans addicted to
